AXIS On Dudley and the RAB Act.

In late 2018 and mid-2019, two significant building defect incidents occurred in Sydney involving the Opal Tower and Mascot Towers, which led to major reforms in building regulations in New South Wales.

These incidents highlighted severe shortcomings in the building and construction industry including the quality of building materials and workmanship, adherence to building codes and the oversight of construction projects. In response, the NSW government introduced several regulatory reforms to address these issues. One significant legislative response was the Residential Apartment Buildings (Compliance and Enforcement Powers) Act 2020 (RAB Act).

The (RAB Act) is a regulatory framework designed to enhance the integrity and quality of residential apartment constructions. Instituted to pre-emptively identify and rectify building defects, the Act empowers the NSW Building Commissioner to conduct audits and enforce compliance up to six months prior to the expected completion of an apartment building. This proactive approach allows for early intervention in potential building issues, thereby mitigating risks associated with structural defects and non-compliance with building standards.

The rationale for the introduction of the RAB Act stems from a series of high-profile defects in new apartment buildings which significantly impacted consumer confidence and the real estate market. By ensuring that buildings meet rigorous standards before occupation certificates are issued, the Act aims to safeguard the interests of consumers and maintain high construction quality. This legislative measure ultimately seeks to restore trust in the residential construction sector, protect property values, and uphold the reputation of NSW’s building industry.

Axis on Dudley was one of the first developments in Newcastle to be completely constructed under this new framework. Over the construction period the building commissioner himself visited the development and upon the application for an Occupation Certificate, the commission undertook a full OC audit.

Axis passed the audit and was granted an Occupation Certificate, a testament to the builder and developer.

As part of this new regulation, the developer must hold a portion of the building cost in a “Strata Bond” for 30 months and serves as a security to fix any defective building work. This system aims to enhance the accountability of developers and builders, ensuring they deliver quality constructions that meet the expected standards.
